Arc HW encoder issues (recording 4K60fps gameplay in The Crew 2 on Arc A770 16GB LE)

showing recording issues with Arc A770 integrated HW encoder,

using OBS for AV 4K60fps capture, featuring:

The Crew 2, pretty outdated now but still decent game,

still shows lower DX11 4K performance than expected.
i’s not possible to achieve 60 fps @4K and sometimes not even 1440p

windows 10 Pro 22H2 up to date, drivers tested from *.3802 up to latest beta (late Feb 2023)

NOTE: there’s also a weired recording issue, no matter what driver, regardless of OBS version or setting,

it’s not possible currently to record a proper 4K@60fps video right now,
it starts lagging, until it’s a terrible slide show with like 10 fps or lower.
ingame it was ‘okay’ with fps ~40+ just the video recorded gets messed up each time..
tried Intel Quick Sync Av1 and also h264 and hevc, same thing everywhere
